Recently, the Ministry of Justice issued the "Opinions on the Implementation of the Comprehensive Promotion of the Cooperative Development of Judicial Expertise in the Yangtze River Economic Zone" (hereinafter referred to as the "Opinions on Implementation") and put forward seven measures to promote the coordinated development of judicial expertise in 11 provinces (cities) of the Yangtze River Economic Zone in an all-round way, give full play to the role of judicial expe The economic and social development of the economic belt has been deployed.


The Yangtze River Economic Zone covers 11 provinces and cities along the Yangtze River, accounting for about 1/5 of the land area of the whole country, contributing more than 2/5 of the total economic output of the whole country, and is an important supporting belt in the overall economic development of our country. In 2017, the judicial appraisal business of the Yangtze River Economic Belt accounted for 52.5% of the total business volume of the whole country. After the Symposium on promoting the development of the Yangtze River Economic Zone was held in April this year, the Ministry of Justice acted quickly and made a series of working arrangements, among which drafting and promulgating the Implementation Opinions was an important part.


The implementation opinion stressed that the Yangtze River economic belt is an important test area for the reform of judicial expertise management system. We should promote the rational planning and layout of appraisal institutions, formulate the development plan of environmental damage judicial appraisal institutions in the Yangtze River Economic Zone, work out the development plan of forensic, material evidence and audio-visual data judicial appraisal institutions step by step, and realize the balanced number, scientific distribution and orderly development of institutions. It is necessary to strictly implement the provisions on the registration of access to judicial expertise, unify the access conditions and professional classification of judicial expertise institutions, establish a database of cross-provincial (municipal) evaluation experts, achieve precise unification in the specific requirements and conditions of access, avoid differential treatment and achieve a threshold access. We should explore the establishment of a daily examination system for appraisers' professional competencies and a system of admissions and examination for registration personnel. It is necessary to promote the application of unified appraisal standards, strengthen the guidance for the application of appraisal standards and norms, and promote the scientific application of standards and norms. We will support the establishment of judicial appraisal bodies and conventions on the integrity and practice of appraisers in the Yangtze River Economic Zone, and carry out inter-provincial cooperation in resolving contradictions and disputes and safeguarding the legitimate rights and interests of appraisers. It is necessary to strengthen the exchange of information in the management of forensic expertise and the cooperation of forensic assistance in different places, and realize the interconnection and resource sharing of the information management system of forensic expertise. We will integrate judicial expertise assistance into legal aid and establish a green channel for inter provincial aid. We should speed up the formulation of the fees for forensic appraisal of environmental damage and alleviate the high cost of environmental damage identification.


The Implementation Opinion clearly states that in order to strengthen inter-provincial coordination and jointly promote implementation, the Ministry of Justice has decided to take the lead of the Judicial Appraisal Administration of the Ministry of Justice, with the participation of the judicial departments (bureaus) of Shanghai, Jiangsu, Zhejiang, Anhui, Jiangxi, Hubei, Hunan, Chongqing, Sichuan, Yunnan and Guizhou provinces (municipalities) to establish the judicial authentication coordination of the Yangtze River Economic Zone.
